Terms of Service
These terms explain the rules that apply when you create, publish, or use a Presbot assistant. Please read them before using the service.
Effective date: .
Agreement to these terms
By creating an account, publishing an assistant, or otherwise using Presbot, you agree to these Terms of Service and to the Presbot Privacy Policy. If you use Presbot on behalf of a business or other organization, you confirm that you have authority to accept these terms for that organization.
If you do not agree to these terms, do not use the service.
What Presbot provides
Presbot provides tools for creating and publishing a website assistant. Depending on your plan and configuration, an assistant may display prepared responses, answer questions using Knowledge you provide or approve, and collect information from visitors who request follow-up.
Presbot does not guarantee that every answer will be complete, current, or suitable for every visitor. You are responsible for reviewing your assistant, testing it on your website, and keeping its information accurate.
Accounts and account security
You must provide accurate account information and keep your login credentials secure. You are responsible for activity performed through your account, except where that activity results from a failure by Presbot to use reasonable security measures.
Tell us promptly through the available support channel if you believe your account has been accessed without authorization.
You may not share access in a way that bypasses plan limits or allows unauthorized people to manage visitor information.
Your assistant and your content
You retain responsibility for the website information, Saved Responses, Quick Topics, Supporting Knowledge, instructions, branding, and other content you add to Presbot.
You confirm that you have the rights needed to use that content and to allow Presbot to process it for the purpose of providing the service.
You must review your assistant before publishing it and after making significant changes. You are responsible for correcting inaccurate, outdated, misleading, infringing, or unlawful content.
Visitor information and follow-up requests
If you configure Presbot to collect visitor information, you are responsible for deciding what information to request, explaining how it will be used, and handling it in accordance with applicable privacy and data-protection obligations.
Do not use Presbot to request highly sensitive information such as passwords, full payment-card details, government identification numbers, medical records, or other information that is not reasonably necessary for the visitor’s request.
You are responsible for protecting exported or copied visitor information and limiting access to people who need it for legitimate follow-up.
Acceptable use
You may not use Presbot to:
- break the law or encourage unlawful activity;
- deceive, impersonate, harass, threaten, or exploit people;
- collect information without a legitimate purpose or appropriate notice;
- distribute malware, malicious code, or harmful links;
- interfere with the service or attempt to bypass security controls;
- probe, scan, or test systems without authorization;
- reverse engineer the service except where applicable law expressly permits it;
- infringe intellectual-property, privacy, or other rights;
- publish content that is fraudulent, defamatory, or unlawfully discriminatory;
- use automated methods to create abusive traffic or evade usage limits;
- resell or provide access to Presbot unless a written agreement allows it.
Plans, billing, and renewals
Presbot may offer Free and paid plans. The features, usage allowances, and current price for each plan are shown on the Pricing page or during checkout.
Paid subscriptions are processed through the available billing provider. Unless the checkout page states otherwise, a paid subscription renews at the end of each billing period until it is canceled.
You may manage or cancel a subscription through the billing tools available in your account. Cancellation prevents future renewal but does not normally create a refund for a billing period that has already begun, except where required by law or expressly stated at purchase.
Taxes may apply depending on your location and billing details.
Usage limits and plan changes
Plans may include limits on assistants, Smart Assistant usage, exports, Knowledge features, or other functionality.
When a limit is reached, some functionality may pause or become unavailable until the usage period resets or the account is upgraded. The Pricing page and in-product notices describe the current behavior.
We may change plan features or prices. When a change materially affects an existing paid subscription, we will provide notice where reasonably required.
Third-party services
Presbot relies on third-party services for functions such as hosting, payment processing, email delivery, analytics, and language-model processing.
Your use of those services through Presbot may also be subject to their terms and privacy practices. Presbot is not responsible for a third-party service outside the parts of that service we control or configure.
Availability and changes
We work to keep Presbot available and useful, but the service may occasionally be interrupted for maintenance, security, provider issues, or circumstances outside our reasonable control.
We may add, change, suspend, or remove features. We will try to avoid changes that unnecessarily disrupt active customers, but we do not promise that every feature will remain available indefinitely.
Presbot does not currently provide a service-level agreement unless one is stated in a separate written agreement.
Intellectual property
Presbot and its software, design, trademarks, documentation, and original content are owned by Presbot or its licensors and are protected by applicable law.
These terms give you a limited, non-exclusive, non-transferable right to use the service while your account remains active and you comply with these terms. They do not transfer ownership of Presbot or its technology to you.
Any feedback you choose to provide may be used to improve Presbot without an obligation to compensate you, provided we do not publicly identify you as the source without permission.
Suspension and termination
You may stop using Presbot at any time and may close your account through the available account or support process.
We may restrict or suspend access when reasonably necessary to protect the service, users, visitors, or third parties; investigate suspected misuse; comply with law; address unpaid charges; or enforce these terms.
Where practical, we will provide notice and an opportunity to correct the issue before terminating an account, unless immediate action is reasonably necessary.
Disclaimers
Presbot is provided on an “as available” basis. To the extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Presbot does not guarantee that an assistant will answer every question correctly, generate inquiries, increase sales, remain uninterrupted, or meet every business or legal requirement.
Nothing in these terms excludes a warranty or right that cannot legally be excluded.
Limitation of liability
To the extent permitted by law, Presbot will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunities arising from use of the service.
To the extent permitted by law, Presbot’s total liability for claims relating to the service will not exceed the amount you paid to Presbot during the twelve months before the event giving rise to the claim.
These limitations do not apply where liability cannot legally be limited.
Changes to these terms
We may update these terms as Presbot changes. The effective date at the top of this page shows when the latest version took effect.
When a change is material, we will provide reasonable notice through the service, by email, or through another appropriate method. Continued use after the updated terms take effect means you accept the revised terms.
